Jakarta (B2B) - Ketua Mahkamah Konstitusi (MK) nonaktif, Akil Mochtar diyakini tidak bekerja sendiri tapi melibatkan pihak lain, maka Komisi Pemberantasan Korupsi (KPK) harus mengusut hakim konstitusi dan pengacara lain.
"Sebaiknya penyidik KPK tidak hanya fokus pada Akil Mochtar tapi juga ke pihak-pihak lain di MK yang diduga terlibat dalam kasus dugaan suap terhadap Akil Mochtar," kata pakar hukum tata negara, Yusril Ihza Mahendra kepada pers di Fakultas Kedokteran Universitas Indonesia (UI) Jakarta, Senin (14/10).
Selain memeriksa hakim, mantan Menteri Hukum dan HAM ini juga menyarankan KPK untuk memeriksa pengacara yang menangani perkara di MK.
"Silahkan melakukan penyelidikan yang luas dan komprehensif agar peristiwa memalukan ini tidak terulang lagi," ungkap Yusril.
Seperti diberitakan sebelumnya, Ketua KPK Abraham Samad memastikan memanggil Prof Maria Farida tanpa izin presiden, sebagaimana saksi pejabat lain, termasuk anggota DPR.
"Nggak perlu (izin presiden). Apa sih kelebihan hakim konstitusi? Dia punya imunitas? Tidak ada," tegas Abraham di Istana Merdeka Jakarta, Jumat pekan lalu (11/10).
KPK akan menempuh prosedur sama terhadap hakim konstitusi. "KPK akan menggunakan upaya paksa, apabila hakim konstitusi tak kunjung datang. Dia harus patuh, kita panggil. Kalau kita panggil tiga sampai empat kali tak datang, kita jemput paksa," ancam Abraham.
Jakarta (B2B) - Chairman of the Constitutional Court (MK) inactive, Akil Mochtar did not work alone but are believed to involve other parties, so Corruption Eradication Commission (The KPK) should investigate constitutional judges, and lawyers in MK.
"The KPK investigators should not only focus on Akil Mochtar, but to the other parties in MK allegedly involved in the alleged bribery case to Akil Mochtar," constitutional law expert, Yusril Ihza Mahendra told reporters at the Faculty of Medicine, University of Indonesia (UI) Jakarta, Monday (14/10).
In addition to examining judge, former Justice Minister, advised KPK to examine a lawyer who handles cases in the Court.
"Please investigate and comprehensive as possible so that this shameful incident will not happen again," Yusril said.
As reported earlier, KPK chairman Abraham Samad sure will summon Prof. Maria Farida without permission president, other officials as witnesses, including members of the House of Representatives.
"I do not need (the President's approval.) What is the excess constitutional judge? She has immunity? Nothing," Samad said at Merdeka Palace in Jakarta, Friday (11/10).
KPK would take the same procedures for constitutional judges. "The Commission will use forceful measures, if the constitutional judges do not come. She must obey. If summon three to four times does not come, KPK would force to pick," Samad said.
