Jakarta (B2B) - Majelis Kehormatan Mahkamah Konstitusi (MK) menyatakan bahwa Ketua MK nonaktif, Akil Mochtar telah melanggar Kode Etik dan Perilaku.
"Dia terbukti bersalah melanggar Kode Etik dan Perilaku, terkait pelanggaran ini, (Majelis Kehormatan) memberi sanksi pemecatan dengan tidak hormat," kata Ketua Majelis Kehormatan MK, Hardjono kepada pers di Jakarta, Jumat (1/11).
Tindak pelanggaran yang dilakukan Akil Mochtar sebagai Ketua MK, kata Hardjono, antara lain melakukan perjalanan ke luar negeri tanpa memberitahu sekretaris jenderal, termasuk perjalanan ke Singapura pada 21 September 2013, dan tidak melaporkan mobil miliknya, Toyota Crown Athlete ke kepolisian.
Hardjono mencatat bahwa Akil juga memanfaatkan nama supirnya untuk menyembunyikan kepemilikan atas mobil Mercedes dan telah mengadakan pertemuan rahasia dengan pihak-pihak yang berkepentingan, yang dikenal sebagai CHN pada 9 Juli 2013.
Akil Mochtar juga menunjuk majelis hakim untuk kepentingannya dan telah memerintahkan sekretarisnya, YS dan sopirnya, DYN, untuk menyimpan dana yang berlebihan ke rekening pribadinya dan menggunakan rekening pribadi mereka untuk menerima jumlah uang yang tidak wajar.
Harjono mengatakan Akil Mochtar juga telah dinyatakan bersalah menerima dana dari pihak yang kasusnya sedang diproses oleh pengadilan.
Akil Mochtar juga terlibat dalam kasus narkoba setelah ditemukan lintingan ganja di ruang kerjanya, tambahnya lagi.
Menyusul keputusan tersebut, Majelis Kehormatan akan meminta Presiden Susilo Bambang Yudhoyono (SBY) untuk secara resmi memberhentikan Akil Mochtar.
Majelis Kehormatan MK dibentuk setelah Akil Mochtar tertangkap tangan oleh Komisi Pemberantasan Korupsi (KPK) karena diduga menerima suap terkait dengan perselisihan hasil Pilkada untuk Kabupaten Gunung Mas di Kalimantan Tengah dan Bupati Lebak, Banten.
Jakarta (B2B) - The Ethics Council of the Indonesian Constitutional Court declared here on Friday that suspended chief justice Akil Mochtar had violated the code of ethics and conduct.
"He has been found guilty of violated the code of ethics and conduct; in view of this, (the Ethics Council) has given him a dishonorable discharge sanction," the Council`s chairman, Harjono, said at a press conference.
Among the violations Akil Mochtar had committed while holding the office of chief justice, Harjono stated, were taking trips abroad without notifying the secretary general, including one trip to Singapore on Sept. 21, 2013, and failing to report ownership of his Toyota Crown Athlete car to the traffic police.
Harjono noted that Mochtar had also used his chauffeur`s name to hide his ownership of the Mercedes car and had held an illicit meeting with an interested party, known as CHN, on July 9, 2013.
Akil Mochtar had also appointed people to the panel of judges to serve his own interests and had ordered his secretary, YS, and his chauffeur, DYN, to deposit excessive funds into his personal account and to use their personal accounts for receiving an excessive amount of money.
Harjono said Akil Mochtar had also been found guilty of receiving funds from parties whose cases were being processed by the court.
Akil Mochtar was also implicated in a drug case when narcotics were found in his office, he stated.
Following the decision, the Council will later request President Yudhoyono to formally discharge him from his office.
The Council was established following Akil Mochtar`s recent arrest by the Corruption Eradication Commission for allegedly receiving bribes linked to disputes over the results of elections for the Gunung Mas district head in Central Kalimantan and the Lebak district head in Banten.
