Jakarta (B2B) - Masalah Century  sudah masuk ranah hukum. Presiden menyatakan, kebijakan tidak dapat diadili. Namun, jika ada implementasi dari kebijakan itu yang menyimpang, dapat dipidanakan.

Demikian disampaikan Presiden dalam pertemuan dengan unsur pimpinan media massa di Gedung Bank Mega, Jakarta, Senin (10/3/2014).

Ketua Komite Ekonomi Nasional Chairul Tanjung menjadi tuan rumah acara ini.

Catatan Kompas, pernyataan Presiden terkait kasus Bank Century tersebut merupakan yang pertama setelah perkara itu dibawa ke Pengadilan Tindak Pidana Korupsi Jakarta pada Kamis pekan lalu dengan terdakwa Budi Mulya selaku Deputi Gubernur Bank Indonesia (BI).

Dalam dakwaan perkara tersebut disebutkan, Budi Mulya bersama Boediono selaku Gubernur BI, Miranda Goeltom selaku Deputi Gubernur Senior BI, Siti Fadjrijah selaku Deputi Gubernur BI, dan Budi Rochadi selaku Deputi Gubernur BI terlibat dalam pemberian fasilitas pendanaan jangka pendek untuk Bank Century.

Sementara Hartadi Sarwono selaku Deputi Gubernur BI, Muliaman Hadad selaku Deputi Gubernur BI, dan Ardhayadi Mitroatmodjo selaku Deputi Gubernur BI, ditulis bersama-sama Budi Mulya terlibat dalam penetapan Bank Century sebagai bank gagal berdampak sistemik.

Saat keputusan penyelamatan Bank Century diambil pada November 2008, Presiden menyatakan sedang berada di Peru dan tidak dilapori atau diminta pendapat.

”Yang ada di Jakarta, Pak Kalla. Tidak mengapa saya tidak dilapori dan tidak diminta pendapat karena mereka memang sudah punya otoritas akan hal itu berdasarkan undang-undang dan hukum,” ujar Presiden.

Namun, Presiden meyakini bahwa yang dilakukan Gubernur BI dan pejabat terkait terhadap Bank Century pada tahun 2008 semata untuk mengatasi dampak krisis ekonomi global di Indonesia.

”Tahun 2008 dan 2009 terjadi krisis ekonomi global. Saya tidak setuju jika ada yang mengatakan, saat itu kita tidak terkena dampaknya,” ujar Presiden.

Presiden juga menyatakan, kebijakan tidak bisa diadili. Jika kebijakan dapat diadili, akan membuat tidak ada yang berani mengambil kebijakan.

Namun, jika implementasi dari kebijakan itu menyimpang untuk beragam kepentingan, termasuk kepentingan sendiri, bisa dipidanakan.

”Jika ada elemen-elemen yang menyimpang, itu harus ditindak secara adil,” kata Presiden.

Presiden juga menuturkan, kasus Bank Century sudah masuk tahap hukum. Hukum jangan dicampuradukkan dengan politik.

Hendrawan Supratikno, anggota tim pengawas DPR untuk penuntasan kasus Bank Century, sepakat bahwa hukum harus dikedepankan dalam kasus Bank Century.

Dengan melihat isi dakwaan Budi Mulya, Hendrawan meyakini, KPK telah menemukan adanya niat jahat dalam kasus Bank Century.

Jakarta (B2B) - Indonesian President Susilo Bambang Yudhoyono has commented on the Bank Century bailout case for the first time, saying that it is being handled by the anticorruption court but a policy cannot be tried.

President Yudhoyono was quoted by Kompas daily on Tuesday as saying that none of state officials dare to make any policy if it can be tried.

This leading Indonesian newspaper also noted that it was the head of states first statement on the bailout of Bank Century (now Bank Mutiara) case after the anti-corruption court tried Budi Mulya, former Bank Indonesias deputy governor, as defendant last Thursday.

However, if the policies were wrongly implemented for the sake of vested interests, including personal interest of those in charge, they were subject to criminal law, he said.

President Yudhoyono further said he was in Peru when the decision to bailout the troubled Bank Century was made in November 2008. He was neither reported nor asked to give his opinion about the decision, he said as quoted by Kompas.

In connection with this Bank Century bailout scandal, Vice President Boediono had repeatedly refused to attend a hearing with the House of Representatives (DPR) team supervising the revelation of the case as he did on February 19.

The Vice Presidents spokesman Yopie Hidayat had said Boedionos stance remained unchanged due to the fact that the DPR had completed the political process of the case and the Corruption Eradication Commission (KPK) was working on it.

Boediono was summoned by the Houses monitoring team, in his capacity as the former Bank Indonesia governor.

Yopie added that Boediono respected the House and the duties of members of parliament, but he also respected the recommendations of the DPRs plenary session on its special inquiry into the Bank Century bailout, saying that this case was handled by law enforcers.

According to Sarifuddin Sudding, one of the supervising team members, Boedionos presence was important to clarify his statement that it was the Insurance Deposit Agency (LPS), which was responsible for giving Bank Century the bailout funds totaling to Rp6.76 trillion.

Sudding argued that the DPR team members were seeking clarification on the statement because the 2004 LPS Law revealed that it was the president who should be held accountable.
