Jakarta (B2B) - Saat ini permohonan uji materi terhadap Pasal 2 huruf G dan I pada UU Keuangan Negara Nomor 17/2003, dan Pasal 6 Ayat 1, Pasal 9 Ayat 1 huruf b, Pasal 10 Ayat 1, dan 3 huruf b serta Pasal 11 huruf A pada UU Badan Pengawas Keuangan Nomor 15/2006, sudah memasuki tahap akhir di Mahkamah Konstitusi.
Indonesia Corruption Watch (ICW) menyatakan khawatir apabila aset Badan Usaha Milik Negara (BUMN) dipisahkan dari keuangan negara, maka aset BUMN akan menjadi ´sapi perah´ untuk dana pemilihan umum 2014.
Menyikapi langkah hukum tersebut, ICW mencurigai Menteri BUMN, Dahlan Iskan, dan Menteri Keuangan, Chatib Basri merestui pelepasan aset BUMN dari negara, karena keduanya tidak berupaya secara tegas melawan gugatan yang berpotensi melakukan privatisasi BUMN.
"ICW mencurigai menteri BUMN dan menteri keuangan merestui judicial review terhadap kedua undang-undang tersebut," kata Peneliti ICW Donal Fariz dalam diskusi di Jakarta, Minggu (17/11).
Dugaan itu menguat, karena salah satu pemohon gugatan uji materi dari Forum BUMN dan Biro Hukum Kementerian BUMN.
Fariz menambahkan, jika aset BUMN terpisah dari aset negara maka timbul sejumlah risiko mengkhawatirkan bagi negara.
"Kalau (permohonan) itu dikabulkan, kami khawatir akan menjadi ´angin surga´ bagi praktik pembajakan dan perampokan BUMN. Kalau MK mengabulkan, maka MK melegalkan perampokan BUMN seperti layaknya politisi," kata dia.

Indonesia Corruption Watch (ICW) expressed to worry if the assets of State Owned Enterprises (SOEs) is separated from the state, the state-owned assets will be a ´source of funds´ for the 2014 general election.
Responding to the judicial review, ICW suspect SOEs Minister Dahlan Iskan, and Minister of Finance, Chatib Basri supports the separation of SOEs assets of financial state, because the two ministers did not seek to oppose the legalization of privatization of state enterprises.
"ICW suspect SOEs minister and finance minister approved the application for judicial review of two law in the Constitutional Court," said ICW researcher Donald Fariz in discussions in Jakarta, Sunday (17/11).
Allegations were strengthened, because one of the applicant´s claim of judicial review, derived from SOEs Forum, and the law firm at SOE Ministry.
Fariz added, if the state-owned assets separate from the assets of the country, will lead to a number of risks to the interests of the Indonesian economy.
"If the (judicial review) pass, we were worried would be ´winds of heaven´ for the practice of piracy and robbery in the SOEs. If the Court granted, the Court legalized robbery SOEs like politicians," he said.
