Jakarta (B2B) - Ketua Pengadilan Tinggi (PT) Banjarmasin, Muhammad Daming Sunusi, dipastikan tidak lolos seleksi calon hakim agung oleh Komisi III DPR RI akibat pernyataannya yang kontroversial saat menjalani fit and propper test.
Pernyataan dimaksud adalah; "Yang diperkosa dengan yang memperkosa ini sama-sama menikmati. Jadi harus pikir-pikir terhadap hukuman mati."
Hingga Selasa sore, setidaknya delapan fraksi di DPR RI meminta kepada para kadernya di Komisi III untuk tidak meloloskan Daming menjadi hakim agung, karena pernyataannya itu mencerminkan bahwa kapasitas Daming belum pantas untuk menjadi seorang hakim agung.
Kedelapan fraksi tersebut adalah PKS, PAN, PPP, Golkar, Hanura, Gerindra, Demokrat dan PDIP.
"Pernyataan kelakar calon hakim agung M Daming Sunusi sungguh tidak patut dan sangat disesalkan. Saya sudah meminta Ketua FPD DPR untuk mengarahkan para anggota FPD di Komisi III agar tidak memilih hakim M Daming Sunusi sebagai hakim agung," kata Ketua Umum Partai Demokrat Anas Urbaningrum dalam siaran persnya, hari ini.
Menurut Anas, lelucon Daming soal perkosaan telah menunjukkan bahwa kapasitas Daming belum memenuhi kualifikasi sebagai hakim agung, sehingga tak layakj dipilih.
Hal senada dikatakan Ketua Umum Partai Golkar Aburiuzal Bakrie dan Ketua Fraksi PKS di DPR RI Hidayat Nur Wahid. Melalui akun Twitternya, Ical mengatakan; "Partai Golkar tidak akan mendukung/memilih Daming Sunusi jadi Hakim Agung karena ucapannya melukai korban pemerkosaan dan merendahkan perempuan".
Dan Hidayat mengatakan, Daming tidak menunjukkan sikap yang pantas sebagai calon hakim agung. "Jadi, instruksi kami adalah, kader PKD di Komisi III mencoret Daming sebagai calon hakim agung, dan menghukumnya dengan dilaporkan ke MA (Mahkamah Agung)," katanya.
Saat sedang menjalani fit and propper test di Komisi III, Daming ditanya tentang pendapatnya terkait wacana menghukum mati seorang pemerkosa, dan jawaban Daming adalah; "Yang diperkosa dengan yang memperkosa ini sama-sama menikmati. Jadi harus pikir-pikir terhadap hukuman mati".
Jawaban ini sempat membuat seluruh anggota Komisi III tertawa, namun kemudian jawaban ini justru menyulut kemarahan banyak kalangan karena dianggap melecehkan wanita, khususnya yang menjadi korban perkosaan.
Diketahui pula, Komisi III memiliki anggota sebanyak 50 orang yang berasal dari sembilan fraksi yang ada di DPR. Jika delapan fraksi menolak, berarti Daming salah satu dari 24 calon hakim agung yang dipastikan takkan lolos menjadi hakim agung, karena dari 24 orang yang mengikuti fit and propper test, Komisi II hanya akan memilih delapan hakim agung.
