Jakarta (B2B) - Peraturan Pemerintah Pengganti Undang-undang (Perpu) tentang Mahkamah Konstitusi (MK) yang ditandatangani oleh Presiden Susilo Bambang Yudhoyono (SBY), Jumat (17/10), telah kehilangan makna dan urgensi. Pasalnya, Perppu untuk MK terlambat diundangkan, setelah Ketua MK, Akil Mochtar ditangkap oleh Komisi Pemberantasan Korupsi (KPK) hampir tiga pekan lalu (2/10).
Mantan Menteri Hukum dan Hak Asasi Manusia (HAM) Yusril Ihza Mahendra mengatakan tenggang waktu lebih dua minggu mengakibatkan unsur kegentingan yang memaksa, mengakibatkan unsur kegentingan yang memaksa sebagai dasar diterbitkannya Perpu tentang MK menjadi kehilangan makna.
"Setelah lebih dua minggu terjadi self recovery di MK, karena intensifnya KPK, Badan Narkotika Nasional, Pusat Pelaporan Analisa Transaksi Keuangan, dan Majelis Kehormatan MK yang menangani kasus Akil Mochtar," kata Yusril melalui pesan singkat via BBM di Jakarta, Jumat (17/10).
Mendukung Perpu
Yusril mengakui bahwa dia mendukung langkah Presiden SBY menerbitkan Perpu dengan segera, sehari atau dua hari, setelah KPK menangkap Akil Mochtar. Saat itulah terjadi kondisi krisis kepercayaan dan keraguan yang luar biasa terhadap MK.
"Dalam situasi seperti itu ada unsur kegentingan yang memaksa sebagai dasar bagi Presiden untuk menerbitkan Perpu guna memulihkan kepercayaan publik terhadap MK," ungkap Yusril.
Menurutnya, berbagai putusan MK dalam dua minggu terakhir, tanpa kehadiran Akil, kepercayaan masyarakat berangsur pulih. Adanya self recovery MK mengakibatkan Perpu yang diterbitkan oleh Presiden SBY pada Jumat (17/10) kehilangan makna dan urgensinya.
"Sebagai mantan Menkumham dan Mensesneg yang dulu sering menangani Perpu, saya heran mengapa begitu lambat Presiden menerbitkan Perppu ini. Padahal, Perpu tentang MK ini tergolong sederhana jika dibanding dengan Perpu Terorisme pasca Bom Bali tahun 2002 yang cukup rumit isinya," imbuhnya.
Krisis kepercayaan terhadap MK, kata Yusril, pasca tertangkapnya Akil Mochtar lebih disebabkan karena tidak ada pengawasan terhadap para hakim konstitusi.
"Apabila Presiden segera menerbitkan Perpu untuk mengawasi para hakim konstitusi di MK, maka kepercayaan akan segera pulih. Para pencari keadilan tidak akan ragu-ragu lagi," ungkap Yusril.

Support the Interim Law Court
Mahendra admits that he supports the president to immediately issue Interim Law Court, a day or two days, after the KPK arrested Akil Mochtar. When that happens a crisis of confidence and a big doubts the Constitutional Court.
"In such a situation there is an element of urgency that forces as a base for the President to issue Interim Law Court to restore public confidence in the Constitutional Court," Mahendra said.
According to him, the various decision of the Court in the past two weeks, without Akil Mochtar, public confidence gradually recovered. The existence of self recovery resulted the Interim Law Court issued by the President on Friday (17/10) loses its significance and urgency.
"As a former minister of law and human rights, and the secretary of state ministers who used to handle the Interim Law, I wonder why the President is so slow issuing Interim Law the Constitutional Court. Fact, this Government Regulation relatively modest when compared with the Interim Law Terrorism after the 2002 Bali bombings that quite complicated contents," he added.
Crisis of confidence to the Constitutional Court, he said, after the arrest of Akil Mochtar more because there is no oversight of constitutional judges.
"If the President immediately issuing Interim Law to oversee the constitutional judges in the Constitutional Court, then the confidence of the people would immediately recovering. Justice seekers no doubt," Mahendra said.
