Jakarta (B2B) - Mahkamah Konstitusi (MK) sepanjang 2012 menerima 287 perkara. Dari jumlah tersebut, 207 perkara di antaranya atau sebesar 72% telah dijatuhkan vonis oleh MK. Sisanya 28% masih dalam proses.
"Saya sampaikan bahwa pada 2012, MK menangani perkara pengujian undang-undang (PUU) sebanyak 169 atau setara dengan 59 persen. Sementara perkara hasil pemilihan umum (PHPU) sebanyak 112 perkara atau 39 persen dan sisanya sengketa kewenangan lembaga negara sebanyak enam perkara atau dua persen," kata Ketua MK Mahfud MD kepada pers saat memaparkan kinerja MK selama 2012 di gedung MK, Jakarta, Rabu (2/1/13).
Mahfud juga mengatakan sepanjang 2012 lalu, MK lebih banyak menolak permohonan perkara dengan persentase 43%. Dia beralasan banyak pemohon yang tidak memiliki kedudukan hukum namun tetap mengajukan permohonan ke MK.
"Secara garis besar, permohonan-permohonan yang masuk ke MK masih disertai argumentasi dan alat bukti yang lemah. Faktanya hanya 20% perkara yang dikabulkan," jelas Mahfud.

Mahfud also said that during 2012 and then, more Court rejected the lawsuit by the percentage of 43%. He reasoned that many applicants have no legal standing but still apply to the Constitutional Court.
"Generally, the incoming requests to the Court was accompanied by arguments and weak evidence. Fact only 20% of cases were granted," said Mahfud.
