Jakarta (B2B) - Komisi Yudisial (KY) mengeluarkan 'fatwa' yang melarang para hakim untuk menjalankan bisnis, sesuai aturan kode etik dan pedoman perilaku hakim.

Larangan ini tampaknya terkait kekayaan hakim Pengadilan Negeri Jakarta Selatan, Yustiningsih Upiek Kartikawati, yang dilaporkan memiliki andil dalam pengelolaan Sky Garden Lounge di Legian Kuta, Bali.

"Berdasarkan kode etik dan pedoman perilaku hakim. Seorang hakim dilarang berbisnis," kata Ketua KY, Eman Suparman usai peluncuran buku biografi dirinya di Gedung KY, Jakarta, Selasa (23/4).

Eman menambahkan, profesi hakim adalah pejabat negara yang digaji oleh negara. "Seharusnya sebagai pejabat negara, seorang hakim tidak boleh merangkap sebagai pengusaha, ini kan juga untuk menghindari konflik kepentingan."

Berdasarkan Laporan Harta Kekayaan Pejabat Negara (LHKPN) ke Komisi Pemberantasan Korupsi (KPK), hakim Upiek melaporkan kekayaannya pada 2002 sebesar Rp2,9 miliar dan US$100 ribu.

Sebagaimana diberitakan, kafe yang berada di Jl Legian No 61 Kuta, Bali itu digugat oleh arsitek asal Inggris, Jones Evan Rees, sebesar Rp27,8 miliar.

Arsitek Rees menggugat Sean Brian McAloney dan PT ESC Urban Food Station, karena belum dibayar padahal sudah bekerja mendesain konsep kafe itu dalam kurun 2005-2007.

"KY akan tindak lanjuti dan akan telusuri kebenaran informasi itu," ujar Eman yang akan segera meminta klarifikasi hakim Upiek perihal kepemilikan kafe tersebut.

Eman added, professional judges are state officials who are paid by the state. "It should be as state officials, a judge should not be doubled as entrepreneurs, is to avoid conflicts of interest."

Based on State Officials Wealth Report (LHKPN) to the Corruption Eradication Commission (KPK), the judge Upiek reported a wealth in 2002 amounted to Rp2,9 billion and U.S. $100 thousand.

As reported, the cafe is located at No. 61 Jalan Legian Kuta, Bali was sued by the British architect, Rees Jones Evan, for Rp27, 8 billion.

Architect Rees sued Sean Brian McAloney and PT ESC Urban Food Station, because of unpaid work after they were designed the cafe concept in the period 2005-2007.

"KY will follow up and will search for that information," said Eman who said it would immediately ask the judge Upiek clarification regarding the ownership of the cafe.
