Jakarta (B2B) - RUU Organisasi Kemasyarakatan (Ormas) lebih represif dibandingkan dengan UU Partai Politik dan Kemasyarakatan Nomor 8/1985 di era rezim Orde Baru. UU bentukan rezim Soeharto lebih sederhana, hanya memuat 20 pasal sementara RUU Ormas era reformasi memuat 88 pasal.
Ketua Majelis Hukum, dan HAM PP Muhammadiyah, Syaiful Bahri mengatakan UU bentukan rezim Orde Baru yang dikenal represif hanya memuat 20 pasal. Penetapan definisi RUU Ormas pun tidak jelas, organisasi massa atau organisasi kemasyarakatan.
"Definisi RUU Ormas sudah menimbulkan kecurigaan berbagai pihak, organisasi kemasyarakatan atau organisasi massa. RUU Ormas lebih represif daripada UU serupa bentukan Orde Baru," kata Syaiful Bahri dalam diskusi ´RUU Ormas Kok Bikin Cemas di Jakarta, Sabtu (29/6).
Selain itu, kata Syaiful, RUU Ormas sebenarnya kehilangan urgensinya karena bukan UU organik yang langsung diperintahkan oleh UUD 1945.
"RUU Ormas bukan undang-undang organik. Organik adalah undang-undang yang langsung diperintah UUD 1945, misalnya UU tentang berserikat dan berkumpul melalui UU partai politik. UU berkumpul yang belum ada. Seharusnya masuk ke situ, digabung saja. Kalau tidak digabung akan terjadi belantara undang-undang," ungkap Syaiful.
