Cooperatives in Indonesia Must Comply the Law to Carry Out the Annual Members Meeting

Makassar, Sulsel (B2B) - Pemerintah mendorong penguatan kelembagaan koperasi namun banyak yang melaksanakan kegiatan usaha tidak sesuai ketentuan undang-undang, per Desember 2015 tercatat 209.488 unit koperasi di seluruh Indonesia, tercatat tidak aktif 62.239 unit (29,72%) dan 147.249 unit (70,30%) dinyatakan aktif, namun hanya 80.008 unit (38,20%) yang melaksanakan Rapat Anggota Tahunan (RAT) dan 67.241 unit (32,10%) mengabaikan perintah UU Koperasi No 17/2012 untuk melaksanakan RAT.
Deputi Bidang Pengawasan Kementerian Koperasi dan UKM, Meliadi Sembiring mengatakan dari total koperasi aktif tercatat sebanyak 110.189 unit yang menjalankan kegiatan Koperasi Simpan Pinjam (KSP) dan jasa keuangan syariah, yakni 10.811 unit KSP, 96.018 unit USP-Kop, 1.197 unit Koperasi Jasa Keuangan Syariah (KJKS) dan 2.163 Unit Jasa Keuangan Syariah (UJKS). Dari total koperasi yang menjalankan kegiatan simpan pinjam dan jasa keuangan syariah tercatat hanya 77.173 unit yang aktif dan hanya 51.873 unit yang melaksanakan RAT.
"Masih banyaknya koperasi yang mengabaikan kewajiban melaksanakan RAT lantaran masih lemahnya kepatuhan koperasi terhadap undang-undang, dan fungsi pengawasan belum dilakukan secara optimal melalui langkah pembinaan, kepatuhan pada undang-undang, pemeriksaan, penilaian kesehatan koperasi, pencegahan, dan penerapan sanksi tindakan," kata Meliadi Sembiring saat memberi pengarahan pada workshop 'Penerapan Kepatuhan Koperasi' di Makassar pada Kamis pekan lalu.
Menurutnya, Pemerintah RI melalui Kementerian Koperasi dan UKM sebagai pelaksana pembinaan dan pengembangan koperasi di Indonesia, melakukan perubahan struktur organisasi dan tata kerja dengan menunjuk Deputi Bidang Pengawasan yang didukung oleh lima asisten deputi: kepatuhan, kelembagaan, pemeriksaan kelembagaan, penilaian kesehatan usaha simpan pinjam, dan penetapan sanksi sesuai Peraturan Presiden RI Nomor 62/2015 tentang Kementerian Koperasi dan UKM.
"Ketika masih berbentuk departemen, dengan jumlah koperasi sekitar 18 ribuan unit di seluruh Indonesia, ditunjuk direktur pengawasan setingkat eselon dua, yang tugasnya melakukan pengawasan terhadap perkembangan aktifitas koperasi," kata Meliadi.
Tampak hadir Kepala Dinas Koperasi dan UKM Provinsi Sulawesi Selatan, H Samsu Alam; Sekretaris Deputi Pengawasan Kemenkop UKM, Daniel Asnur; Asisten Deputi Kepatuhan pada Deputi Bidang Pengawasan, Mochammad Yusuf Choerullah; dan Kepala Bagian Umum Deputi Pengawasan, Rudy Witjaksono. Sementara yang menjadi narasumber workshop adalah Tenaga Ahli di Kemenkop UKM, Soebroto Hadi Soegondo; dan akademisi Universitas Diponegoro Semarang, Edy Rahardja.
Workshop Kepatuhan Koperasi
Terkait kegiatan workshop di Makassar, Meliadi menyebut dalam hal kepatuhan usaha, keuangan, legalitas, dan advokasi maka diharapkan melalui lokakarya tersebut dapat memperoleh informasi tentang mekanisme dan implementasi pengawasan koperasi di daerah khususnya di Sulawesi Selatan.
"Makassar dipilih karena posisi strategisnya mewakili Indonesia bagian timur dengan besarnya potensi sumber daya manusia atau SDM, dan workshop ini akan menjadi role model bagi daerah lain untuk mengikuti. Saya ingin mendapat masukan dari yang tentunya lebih mengetahui permasalahan koperasi di daerahnya, silahkan ngomong apa saja sebagai masukan bagi kami," kata Meliadi, yang juga mantan Deputi Bidang Pengkajian di Kemenkop UKM.
Menurutnya, kegiatan workshop di Makassar merupakan rangkaian kegiatan untuk mengonsolidasikan peran pengawasan terhadap penerapan asas dan prinsip koperasi maupun kepatuhan pada UU Koperasi No 17/2012 melalui peningkatan kepatuhan terhadap legalitas, usaha dan keuangan serta transaksi.
"Sebagai kepanjangan tangan pemerintah pusat di daerah dan mendukung tugas fungsi kami, maka telah dilakukan optimalisasi peran 3.000 satuan tugas pengawasan koperasi yang dibentuk pada 2015, dan tersebar di seluruh provinsi, kabupaten, kota dan telah memiliki konvensi pengawasan koperasi," kata Meliadi.

Of the total of the cooperative that runs the activities of savings and loans, and Islamic financial services unit recorded only 77,173 are active and only 51,873 units that carry out the RAT.
It was attended by Head of Department of Cooperatives of South Sulawesi province, H Samsu Alam; Supervision Deputy Secretary in the ministry, Daniel Asnur; Deputy Assistant for Compliance, Mochammad Yusuf Choerullah; and the Head of General Affairs, Rudy Witjaksono. While the keynote speech is Expert Staff at the ministry, Hadi Subroto Soegondo; and academics of Semarang's Diponegoro University, Edy Rahardja.
"There are still many cooperatives that ignores the obligation to carry out RAT because the lack of compliance of the cooperative to the law, and monitoring functions have not been optimized through the development, obedience to law, inspection, health assessments cooperative, prevention, and impose sanctions," said Mr. Sembiring as keynote speech at the workshop entitled ''Cooperatives Comply to the Laws' here on Thursday last week.
According to him, the Indonesian government through the Indonesian Cooperatives and SMEs Ministry as a builder of cooperatives in Indonesia, make changes to the organizational structure and working procedures by appointing a deputy for supervision backed by five deputy assistant: compliance, institutional, examination of institutional, health assessments savings and loans, and sanctions accordance Presidential Decree No. 62/2015.
"When the ministry it was as the department, the number of cooperatives around 18 thousand units across Indonesia, and was appointed director for supervision of second echelon official, whose duties oversee the development of the cooperatives," Mr Sembiring said.
Workshop in Makassar
Related to the workshop activities in Makassar, Mr Sembiring call for compliance business, financial, legal, and advocacy it is expected that through the workshop can get information on the mechanisms, and the implementation of cooperative supervision in the area, especially in South Sulawesi province.
"Makassar been selected, because strategic position represents the eastern part of Indonesia with the potential of human resources, and this workshop will be a role model for other regions. I want to get input from participants on the subject of cooperatives here, please say anything as input for us," Mr Sembiring said who is also a former of the Deputy for Assessment in the ministry.
According to him, the workshop activities in Makassar a series of activities consolidation of control over the principle of cooperation and obedience to Cooperative Law No. 17/2012 through increased compliance with legal, financial, and transaction.
"As the representative of the central government in the region, and support the work of our functions, it has been done to optimize the role of 3,000 units of stewardship that was formed in 2015, and spread across the province, county, city, and supported by the convention supervision of cooperatives," Mr Sembiring said.
