Jakarta (B2B) - Pemerintah RI akan segera menerbitkan surat edaran (SE) tentang netralitas aparatur sipil negara (ASN) dalam penyelenggaraan pemilu kepala daerah serentak.
"SE-nya sedang disusun, yang jelas ini tentang netralitas ASN dalam pilkada," kata Menteri Pendayagunaan Aparatur Negara dan Reformasi Birokrasi Yuddy Chrisnandi di Jakarta pada Kamis (23/7).
Menurutnya, telah ada UU No 23 tentang Otonomi Daerah yang melarang ASN terlibat dalam kampanye atau menjadi tim sukses calon kepala daerah tertentu.
Selain itu Peraturan Pemerintah (PP) No 53/2010 tentang disiplin PNS juga telah mengatur hal serupa.
Sementara SE yang akan segera diterbitkan bertujuan mengingatkan ASN dan pihak terkait atas keberadaan aturan-aturan tersebut.
"SE ini guna memastikan aturan berjalan, dan menyegarkan ingatan ASN serta semua pihak, untuk tidak mengikutsertakan ASN dalam kegiatan kampanye pilkada," katanya.
Yuddy menekankan pemberian sanksi bagi ASN yang terlibat dalam pilkada mengacu kepada UU yang berlaku. Keterlibatan ASN dalam pilkada sudah masuk taraf pelanggaran sedang hingga berat. "Jadi sanksinya tidak ringan lagi tapi sedang hingga berat."
Sanksi sedang antara lain berupa penundaan tunjangan gaji berkala, penundaan pembayaran tunjangan kinerja, penundaan kenaikan jabatan dan promosi jabatan.
Sedangkan sanksi berat berupa pemberhentian dari jabatan, penurunan pangkat satu tingkat, pemberhentian dengan hormat, hingga pemberhentian dengan tidak hormat plus tidak mendapatkan pensiun.
Jakarta (B2B) - Indonesia's Administrative and Bureaucratic Reform Minister, Yuddy Chrisnandi stated the government will soon issue a circular that regulates neutrality of state officials in the simultaneous regional head elections.
"The circular is being drafted. Clearly, it is about neutrality of state officials in the elections," Mr Chrisnandi said here on Thursday (7/23).
He admitted that the neutrality of state officials in elections has been regulated under Law No. 23 on Regional Autonomy that prohibits state officials of involved in campaigns or being part of a campaign team of any election candidate. Moreover, Government Regulation No. 53 of 2010 on the discipline of civil servants has also been set up.
The minister added the circular that will be issued aims to remind state officials and related parties of the existence of the rules.
"The circular is to ensure that the rules are followed properly and to refresh the memory of state officials and relevant parties to not include state officials in election campaign activities," Mr Chrisnandi said.
The minister emphasized that the sanctions imposed on state officials involved in the elections will be in accordance with the applicable law. The state officials who are involved in elections will be charged with moderate to severe level of violation.
Mr Chrisnandi pointed out that the moderate sanctions will lead to a delay in regular salary allowances, postponement of performance payments, and delays in advancements and promotions.
Meanwhile, severe sanctions that will be imposed include dismissal from office, demotion by one level, honorable or dishonorable discharge, and ineligibility for pension.
