Jakarta (B2B) - Perampasan harta koruptor sebagaimana yang dituntutkan terhadap terdakwa kasus suap pembahasan anggaran Angelina Sondakh merujuk pada kesepakatan United Nations Conference Against Corruption 2003 (UNCAC).

"UNCAC menyebutkan bahwa pelaku tindak kejahatan korupsi itu harus ada penyitaan atau perampasan (atas harta) yang didapatkan dalam kaitan dengan korupsi itu," kata juru bicara Komisi Pemberantasan Korupsi (KPK) Johan Budi SP di kantornya di Jakarta, Kamis (20/12).

Johan Budi menambahkan, kesepakatan UNCAC 2003 tersebut sudah diratifikasi melalui Undang-Undang Nomor 7 tahun 2006 yang juga dijadikan rujukan oleh KPK untuk penggunaan pasal 18 UU No 31/1999 tentang Pemberantasan Tindak Pidana Korupsi.

"Pasal 18 merujuk pada anjuran UNCAC 2003, ketentuan PBB melawan korupsi, yang sudah diratifikasi dalam UU No 7/2006, mengatur tentang penyitaan hasil kejahatan," ujar Johan.

Johan mengatakan penggunaan pasal 18 dalam tuntutan terhadap terdakwa kasus suap pembahasan anggaran, Angelina Sondakh, berdasarkan pertimbangan bahwa uang yang diduga diterima terdakwa merupakan jatah anggaran pembangunan di Kementerian Pendidikan dan Kebudayaan.

"Karena kami anggap bahwa yang diduga dia terima adalah bagian yang seharusnya untuk pembangunan di Kemdikbud, sehingga KPK menggunakan Pasal 18," ujar dia.

Johan menyebutkan bahwa pasal 18 UU 31/1999 juga beberapa kali dikenakan kepada sejumlah tersangka kasus korupsi.

Oleh karena itu, lanjut Johan, komisinya menyerahkan sepenuhnya penilaian tepat tidaknya penggunaan pasal 18 UU 31/1999 dalam kasus Angie terhadap majelis hakim.

"Kami serahkan pada hakim apakah penggunaan pasal 18 itu tepat atau tidak berdasarkan bukti-bukti yang sudah disampaikan KPK kepada majelis hakim," kata Johan.

Angelina Sondakh, terdakwa dalam kasus suap pembahasan anggaran di Kementerian Pemuda dan Olahraga serta Kementerian Pendidikan dan Kebudayaan dituntut dengan hukuman penjara selama 12 tahun.

Angelina Sondakh, the defendant in the bribery case budget discussions at the Ministry of Youth and Sports and the Ministry of Education and Culture is charged with imprisonment for 12 years.
