Jakarta (B2B) - Tim Konsultatif Independen meminta Presiden Joko Widodo menjaga kehormatan (marwah-red) institusi Polri dan Komisi Pemberantasan Korupsi (KPK) dengan mengeluarkan keputusan terkait Wakil Ketua KPK Bambang Widjojanto (BW) dan calon Kapolri Komjen Pol Budi Gunawan (BG).
"Presiden seyogyanya memberikan kepastian terhadap siapapun penegak hukum yang berstatus tersangka untuk mengundurkan diri dari jabatannya selama berstatus sebagai tersangka demi menjaga marwah institusi penegak hukum, baik Polri maupun KPK," kata Syafii Maarif mewakili Tim Konsultatif Independen dalam keterangan pers di Gedung Sekretariat Negara Jakarta, Rabu sore.
Tim yang beranggotakan sembilan orang itu juga meminta Presiden Joko Widodo tidak melantik calon Kapolri dengan status tersangka dan mempertimbangkan kembali untuk mengusulkan calon baru Kapolri agar institusi Polri segera dapat memiliki Kapolri yang definitif.
"Presiden seyogyanya menghentikan segala upaya yang diduga merupakan kriminalisasi terhadap personel penegak hukum, siapapun, baik Polri maupun KPK dan masyarakat pada umumnya," kata Syafii Maarif.
Tim yang beranggotakan pakar di bidang hukum dan juga mantan pimpinan Polri serta tokoh masyarakat tersebut juga merekomendasikan Presiden untuk memerintahkan Polri maupun KPK untuk menegakkan kode etik terhadap pelanggaran etika profesi yang diduga dilakukan oleh personel Polri maupun KPK.
"Presiden agar menegaskan kembali komitmennya terhadap pemberantasan korupsi dan penegakan hukum pada umumnya sesuai harapan masyarakat luas," kata Syafii Maarif.
Sementara anggota tim lainnya, Jimly Asshidiqie, mengatakan bila Presiden tidak melantik calon Kapolri, maka tidak bisa digunakan sebagai alasan untuk pemakzulan Presiden.
"Tidak akan jadi alasan impeachment (tidak akan bisa jadi alasan pemakzulan-red) kalau korupsi, tindak pidana berat, atau melakukan perbuatan tercela, ini bukan dalam kapasitas pribadi yang melanggar hukum sehingga tidak bisa dijadikan impeachment," kata mantan Ketua Mahkamah Konstitusi itu.
Imam Prasojo, yang juga menjadi anggota tim itu mengatakan bisa memahami dilema yang ada.
"Setelah tim ini berdiskusi memahami hukum dan opini di DPR dan menyelami nurani di masyarakat kaitannya dengan masalah ini, seandainya dilantik akan menimbulkan kontroversi penegak hukum dalam status sebagai baik Wakil Pimpinan KPK dan Kepala Polri, dengan status tersangka akan menimbulkan kegamangan (dalam menjalankan tugas-red)," kata Imam.
Ia menambahkan, "Kami sudah pertimbangkan semua, kami tidak ada kepentingan, (kami-red) hanya berpikir untuk jangka panjang bahwa pimpinan KPK dan Polri kalau tersangka tidak akan memiliki kredibilitas. Mudah-mudahan ini dibaca sebagai keputusan yang adil".
Tim Konsultatif Independen yang berjumlah sembilan orang beranggotakan mantan Ketua Mahkamah Konstitusi Jimly Asshidiqie, mantan wakil pimpinan KPK Erry Riyana Hardjapamekas dan Tumpak Hatorangan Panggabean, sosiolog Imam Prasodjo, dosen PTIK Bambang Widodo Umar, mantan Kapolri Jenderal (Purn) Sutanto, mantan Wakapolri Komjen (Purn) Oegroseno dan tokoh Masyarakat Prof. Dr. Syafii Maarif.
Pada Rabu (28/1), tim tersebut bertemu presiden dan menyampaikan pandangan atas masalah tersebut ke Presiden. Seluruh anggota tim hadir, kecuali Jenderal (Purn) Sutanto yang berhalangan hadir. (Ant)
Jakarta (B2B) - The Indonesian President Joko Widodo has been advised to not induct Police Comm. General Budi Gunawan as the new national police chief to preserve the institutions honor.
"The president must assure that any law enforcement official who has been named a suspect must resign or not hold any official post to preserve the honor of the police and the Corruption Eradication Commission (KPK) institutions," Syafii Maarif, the chief of the Independent Consultative Team set up by President Joko Widodo to help him settle the current conflict between the police and KPK, stated at a press conference here on Wednesday after a meeting with the president.
He remarked that the president must immediately issue a decision with regard to the future of KPK Commissioner Bambang Widjojanto and Commissioner General Budi Gunawan.
President Joko Widodo recently postponed the induction of Commissioner General Budi Gunawan as the new national police chief after he was named a suspect by the KPK, although the parliament has approved Gunawans candidacy.
In the meantime, the police have named Bambang Widjojanto as a suspect on a charge of asking a witness to make a false testimony to ensure that his client won in a dispute over the result of a district head election in Kotawaringing Barat, Central Kalimantan, in 2010, while he was still a lawyer.
Mr Maarif said the independent team had advised President Joko Widodo to consider proposing a new candidate for the national police chief, so that the institution would have a definitive chief.
"The president must halt any efforts allegedly aimed at merely criminalizing the law enforcement officials, be it the police or the KPK officials or anyone," he noted.
The team also recommended that President Joko Widodo should order the police and KPK to enforce a code of ethics to deal with alleged ethical violations committed by personnel from the police or KPK.
"The president must reaffirm his commitment towards corruption eradication and the rule of the law to meet public expectations," Mr Maarif said.
Jimly Asshidiqie, a team member, said President Joko Widodo could not be impeached if he failed to induct Commissioner General Budi Gunawan.
"This could not be used to impeach him. The president could only be impeached if he committed corruption, a serious crime, or an indecent act. The cancellation is not a law violation done under his personal capacity, and so, it cannot be used to impeach him," the law professor and former constitutional court chief justice remarked.
Imam Prasojo, another team member, said he could understand the dilemma faced by the president.
"After the team held a discussion and tried to understand the law and opinions in the DPR (House of Representatives) and the general public over the issue, it was certain that if the induction is to be continued, it would cause a controversy," Mr Prasojo said.
"We have taken all factors into consideration, and we have no vested interests. We only think that the KPK or police leaders who have been named as suspects will lose credibility. We hope that the decision will just be viewed as a decision," he added.
