Tim Independen Atasi Konflik KPK-Polri Dinilai Fadli Zon Sudah Tepat

Jakarta (B2B) - Fadli Zon, Wakil Ketua DPR RI menilai pembentukan tim independen oleh Presiden Joko Widodo untuk mengatasi kekisruhan antara KPK dan Polri sudah tepat.

"Saya menilainya sudah tepat, artinya presiden mengambil langkah untuk meminta pendapat dari para pakar hukum kemudian membentuk tim independen," kata Fadli, Senin (26/1).

Fadli mengatakan pembentukan tim independen itu harus memiliki jangka waktu sehingga diharapkan lebih cepat menyelesaikan persoalan.

Dia menilai proses hukum yang terjadi tidak bisa diselesaikan 'secara adat' sehingga harus diselesaikan secara hukum.

"Jadi tidak bisa sistem kompromi kecuali memang tidak ada dasar-dasarnya setelah dicek kembali. Misalnya tidak ada unsur pidananya dan ada koreksi," ujarnya.

Dia berharap setelah pembentukan tim independen itu, permasalahan di antara kedua institusi tersebut bisa diselesaikan. Menurut dia, proses hukum sudah berjalan sehingga yang penting menyelamatkan institusi Polri dan KPK.

"Tidak ada yang imun di republik ini. Institusi kita mengatakan bahwa setiap warga negara berkedudukan sama di hadapan hukum dan pemerintahan," ujarnya.

Dia mengatakan apabila ada permasalahan hukum, itu harus diselesaikan sesuai dengan aturan konstitusi. Yang penting, kata Fadli, tidak boleh ada politisasi dan kriminalisasi terhadap proses yang berjalan.

"Saya kira harus ada dasar untuk mengeluarkan keputusan apa pun, tidak bisa karena desakan kemudian harus ada SP3 (Surat Perintah Penghentian Penyidikan)," katanya.

Sebelumnya Presiden Jokowi memanggil sejumlah tokoh untuk mendapatkan masukan terkait kisruh KPK-Polri pada Ahad (25/1). Para tokoh tersebut akan menjadi tim independen yang terdiri dari berbagai kalangan.

Tim tersebut terdiri dari mantan Ketua Mahkamah Konstitusi (MK) Jimly Asshidiqie, mantan Wakapolri Komisaris Jenderal (Purnawirawan) Oegroseno, mantan Wakil Ketua Komisi Pemberantasan Korupsi (KPK) Tumpak Hatorangan Panggabean, dan Erry Riyana Hardjapamekas.

Selain itu ada mantan staf ahli Kapolri Bambang Widodo Umar, pakar hukum internasional Hikmahanto Juwana, dan mantan Ketua PP Muhammadiyah Syafii Maarif.

Jakarta (B2B) - Fadli Zon, seputy speaker of the Indonesian parliament said President Joko Widodo has taken the right step in forming an independent team to help end the conflicts between police and the Indonesia Anti-graft Body, known as KPK.

"I think the president is right to seek advice from law experts and then formed an independent team to seek an end to the conflict," Mr Zon said here on Monday.

On Sunday night President Widodo invited law experts including former police chief and former KPK chairman to ask their opinion to to end the conflict.

The conflict began when KPK named police Comr. Gen.Budi Gunawan a corruption suspect.

The KPK's decision came all of a sudden after the president named Budi candidate to replace police chief Gen. Sutyarman and a day before the parliament held the standard procedure of fit and proper test for the candidate.

In what looked like a retaliation, police named Bambang Widjajanto a suspect and arrested him on charge of false testimony at a Constitution Court investigating a dispute over regional election in Kotawarining, Kalimantan in 2010.

Mr Zon said the team needs to have a working schedule to settle the the problem immediately.

"Legal cases have to be settled legally. No compromise unless there is no legal basis" he added.

He said he hoped the conflict between the two law enforcement agencies could be ended immediately.

"Legal process has been in progress . What is important is saving the police and KPK institutions," he said.

"No one is immune in this republic. Our constitution says all citizens are equal before the law. What is important is there must not be politicization and criminalization," he added.

He said there must legal basis for any decision whatsoever and decision must not be made on pressure to order stoppage of legal investigation (SP3).

There have been call to issue SP3 for the case involving Bambang Widjajanto. There was even suggestion to give immunity for KPK commissioners to protect them from criminalization.

The independent team is made up of former Constitutional Court chief justice Jimly Asshidique, former deputy police chief Comr.Gen.(retired) Oegroseno, former deputy chairmen of KPK Tumpak Hatorangan Panggabean and Erry Riyana Hardjapamekas, former expert staff of police chief Bambang Widodo Umar, international law expert Hikmahanto Juwana, and former chairman of Muhammadiyah Syafii Maarif.
