Jakarta (B2B) - Pemilihan umum legislatif dan pemilihan presiden yang diselenggarakan serentak tidak akan menimbulkan kekacauan.
Yusril Ihza Mahendra menyakini jika Mahkamah Konstitusi mengabulkan permohonannya, pemilu serentak tidak akan menimbulkan kekacauan.
"Tidak akan ada kerusuhan, kekacauan, kalau MK mengabulkan permohonan saya, sebab permohonan saya adalah pemilu DPR dan DPRD untuk diundur sampai Juli 2014. Pelantikan anggota DPR dan DPRD tetap 1 Oktober, pelantikan presiden 20 Oktober," kata Yusril Ihza Mahendra, yang mengajukan permohonan uji materi UU Pemilihan Presiden di Jakarta, Selasa (21/1).
Yusril mengatakan MK mengabulkan permohonannya, maka pemilu akan disatukan dan KPU harus siap melaksanakan putusan MK.
Dalam permohonannya, Yusril menguji pengujian Pasal 3 ayat (4), Pasal 9, Pasal 14 ayat (2), dan Pasal 112 UU Pilpres yang dinilai bertentangan dengan UUD 1945.
Menurut Yusril, Pasal 4 ayat (1) dan Pasal 7C UUD 1945, sistem pemerintahan Indonesia menurut UUD 1945 adalah sistem presidensial.
Dia melanjutkan, dikaitkan dengan sistem ini, maka maksud frasa dalam norma Pasal 22E ayat (1), (2) dan (3) yakni pemilihan umum dilaksanakan "setiap lima tahun sekali" untuk memilih anggota-anggota Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, Presiden dan Wakil Presiden dan Dewan Perwakilan Rakyat, adalah pemilihan umum dilakukan serentak dalam waktu yang bersamaan.

Yusril is filing a judicial review with the MK regarding the Presidential Election Law, which stipulates a legislative election and a presidential election to be held separately.
Based on the law, the legislative election will be held on April 9 and the presidential election on July 9, 2014.
"I have requested the MK to postpone the legislative elections until July 2014 (to be held simultaneously with the presidential election). The inauguration of the elected legislators will be held as per schedule on October 1, and the President-elect will be on October 20, 2014. So, there will be no chaos, except if there are parties intending to disrupt the proceedings," Yusril noted.
In the dossier of his judicial review request, Yusril urged the MK to review the Article 3 point 4, Article 9, Article 14 point 2, and Article 112 of the Presidential Election Law, which he believes were against the 1945 Constitution.
According to Yusril, Article 4 point 1 and Article 7C of the 1945 Constitution stipulate that the Indonesian government, based on the Constitution, adopts a presidential system.
If the presidential system is related to Article 22E point 1, 2, and 3, it is evident that a general election is held once in every five years. The election is held to vote for the members of the House of Representatives, Regional Representatives Council, the President, and the Vice President. They should be held concurrently based on the Constitution, he remarked.
